Cormier v. Dist. of Columbia Water & Sewer Auth. 959 A.2d 658 (D.C. 2008)

This case established that unsworn declarations that comply with the requirements of 28 U.S.C. § 1746 are considered “affidavits” within the meaning of the summary judgment rule. The decision lead to the amendment of Rule 9-I of the D.C. Superior Court Rules of Civil Procedure which now permits the use of unsworn declarations in all Superior Court cases.
